These Terms & Conditions govern the use on which you may make access to our website www.workathomemums.com.au (and all related sub-pages). Please read carefully before you use the site. By using our site, you indicate that you accept these Terms & Conditions and that you agree to abide by them. If you do not agree to these, please refrain from using our site.

Personal Information & Privacy

We take your privacy seriously and we are bound by the National Privacy Principles in the Privacy Act 1988 (Cth).

Use of the Site

The services and information on the Work At Home Mums are provided for purpose of individuals looking for employment opportunities and related services and for employers and recruiters seeking to recruit staff. You may print, download and use information from the site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, transmit or distribute any material from the site. Work At Home Mums acts only as a connection partner through whom Candidates seek employment, and Employers/Agencies seek staff.

Copyright, database rights and other intellectual property rights belong to Work At Home Mums and its third party suppliers. Use of the site does not give you any proprietary rights in such materials.

Service Availability

We make all reasonable efforts to ensure the continuous availability of the site and all the services available on the site; however, we accept no responsibility for the consequences of interruptions to the site.

Limitation of Liability

Our liability, and the liability of our third party suppliers, for any loss or damage suffered by you as the result of your use of this site is limited to your actual direct damages and excludes any loss of future earnings, profit or prospects or any consequential or speculative loss. As required by law, this exclusion does not extend to death or personal injury caused by our negligence.

Job Advertisements

Job advertisements contained on the site are provided by prospective employers and their agents. We accept no responsibility or liability for the content of advertisements. It is the Candidate’s responsibility to satisfy themselves that the advertisement is genuine and that the details he or she provides the advertiser are appropriate to the role advertised. The Candidate warrants that in responding to any Advertisement or making inquiries of an Advertiser he or she does so as a genuine potential candidate in his or her own personal, non-commercial capacity.

Job Board Services

Information, tools and services provided on the site are intended to assist in the recruitment process for both Candidates and Employers/Recruiters. Neither we nor our third party suppliers can guarantee their suitability or prospects of success in any particular case.

Security

The Candidate must take reasonable care in protecting against unauthorised use of log-on details.  We are not responsible for any unauthorised access to the Candidate’s stored information.

Indemnity

The Candidate indemnifies Work At Home Mums from any claim, loss or liability arising directly or indirectly from any personal details submitted to an Advertiser.

Job Posting

Without limiting the generality of any other provision in these Terms & Conditions, the Employment Advertiser warrants that any Advertisement will comply with the Human Rights and Equal Opportunity Commission Act 1986 (Australia), and all relevant anti-discrimination and equal opportunity legislation, and/or all applicable legislation, regulations, by-laws, ordinances or codes of conduct in all applicable States and Territories of Australia.

We have rules regarding the format and content of jobs posted on Work At Home Mums. The purpose of the rules is to ensure that users who search the site get results which are presented in a clear and informative way. You agree that we may remove from Work At Home Mums any advertisement which is posted in breach of these rules; this is at our discretion and without liability to you. The rules are

  • No multiple posting of exactly the same job unless the same job available in different locations.
  • Job advertisements placed must be for genuine vacancies only. The Advertiser warrants that the advertisement submitted for publication and the advertisement as published is a genuine position as described in the advertisement and that the sole purpose of the advertisement is not misleading or deceptive to potential candidates or other persons.
  • Deliberate repetition of strings of keywords in the job title, in order to influence the position of the job ad in the job listings, is not acceptable.
  • Any advertisements which discriminate on grounds of sex, race or disability or appear to discriminate on these grounds are illegal and may result in proceedings being taken against both the advertiser and the publisher.
  • If we believe that an advertisement may be discriminatory or offensive we may, at our discretion, either amend the advertisement or remove it from the Job Board without liability to you. You will indemnify us against any claim that the advertisement infringes the intellectual property rights or other rights of others or is defamatory or otherwise offensive.
  • The Advertiser warrants that it will not use any information obtained from any candidates for the purpose other than the assessment of the persons’ suitability for the role being advertised. The advertiser will comply with the Spam Act 2003 and the Privacy Act 1988 and applicable regulations under such legislation and the National Privacy Principles.
  • The advertisement does not contain any material that is defamatory, threatening, harassing, abusive, discriminatory, unlawful, obscene, offensive, profane, indecent or otherwise objectionable material of any kind.

Illegal Advertisements

All advertisers must comply with the ACCC business guide "Misleading job and business opportunity advertisements and how to handle them". This publication can be accessed online via the ACCC website.

Refund Policy

We will review a request for a refund on an individual case basis. Refunds will be provided less credit card processing and administration fees only where proof and evidence of an error has occurred that is due to a technical fault or technical defect of the website.

Refunds will not be provided where an advertiser has incorrectly submitted an advertisment for publishing. The Advertiser is responsible for proof reading and checking all advertisements placed. The Advertiser acknowledges and agrees that Work At Home Mums may reject, remove or suspend advertisements at any time should it so wish if the job advertisement breaches the Terms & Conditions of the site and there is a no refund policy.

All payments made to Work At Home Mums for advertisements are non refundable and will not be returned if you terminate your agreement with us while it contains a credit balance. We reserve the right to immediately terminate your access to the site in its absolute discretion for any reason, in particular where you breach the Terms & Conditions.

Responses to Advertisements

You agree to deal in a fair and professional manner with individuals who may respond to an advertisement you have posted and not do anything which may bring Work At Home Mums into disrepute. You will indemnify us from and against any claim brought by an individual against Work At Home Mums arising from your breach of this obligation or any other of these Terms & Conditions..

We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out any checks and procedures that are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and other skills and characteristics. Before engaging the services of, offering a job to, accepting any job from, or attending any interview with another user of our site you should ensure that you have carried out adequate research, due diligence and / or reference checks to ensure that the other user is bona fide.

Displaying Advertisements

Your sole remedy if we make an error in displaying an advertisement is to provide you with another advertisement. We shall have no liability for failure to display the advertisement caused by circumstances outside of our control. Neither we nor our subcontractors shall be liable in any circumstances for any loss of profit or business.

Content & Links

It is your responsibility to maintain any external links that your advertisement may point to. We may remove from Work At Home Mums any advertisement which contains content or links to a site which, in our opinion, is illegal, offensive or objectionable or will bring Work At Home Mums into disrepute. You will indemnify us from and against any claims or liability arising from content or links contained in your advertisements.

Third Party Sites

Vacancies you post on Work At Home Mums may also appear on third party recruitment web sites pursuant to agreements from time to time between Work At Home Mums and the proprietors of such web sites.

Employment Agencies & Employment Businesses

The Advertiser warrants that it will not use any information obtained from any candidates for the purpose other than the assessment of the persons’ suitability for the role being advertised. The advertiser will comply with the Spam Act 2003 (Cth) and the Privacy Act 1988 (Cth) and applicable regulations under such legislation and the National Privacy Principles.

Advertisements

Advertisements posted on Work At Home Mums will remain live for 30 days. Each Advertisement will contain one listing in a single category or banner advertisment for the standard display time. Each additional listing, additional category or extension of display time will be charged at the applicable rate.   

Viruses, Hacking & Other Offences

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.
