Please Help, What Do I Do? Need Advice

Question: I have been working for a doctor for the past six months in small remote town two months ago he told me that he did not want me to work there anymore he told me that if i resigned he would write a reference for me if I  did not resign he would not give me the letter but in the next breath told me i had to say one more month an train another person. Just last week he told me how happy he was with what I was doing and that he wanted me to stay. Yesterday told me that again he did not want me to be there but now to leave at the end of September. I don’t know what to do, please give me some advice?

 

 

Answer: It is difficult to give you advice with the limited information you have provided.  My advice would be to first approach your employer and ask the reason why he is terminating your employment.  I would also suggest that you ask for a letter outlining these details with information regarding what will be included in your final payment.  Once you have all of this information it allows me to provide you with some informed advice.

 

In addition to this, I need to understand how many employees your employer employs, how long you have been employed and in what capacity, i.e. permanent, casual etc.  What type of employer they are: constitutional corporation, partnership etc.

 

Useful information to consider:

 

The Workplace Relations Amendment (Work Choices) Act 2005 became fully operative from 27 March 2006 and as a result of this employees of constitutional corporations cease to have application for unfair dismissal provisions.  Also employees who work for a constitutional corporation who employ less than 100 employees are exempt from the unfair dismissal provisions.  Therefore, if your employer fits into this category you are not covered under such provisions.

 

There are other avenues you could possibly explore however I would need the above information in order to provide any useful advice.
